Biopharma IP Issues in Emerging Markets: Brazil and India
Newark, January, 2012 - The NJIPLA hosted the first of a series of CLE programs dedicated to biopharma IP issues in emerging markets, at the Newark Club on January 18th.
Over the next five years, the biggest area of growth for biopharma products is expected to be in emerging market countries, including the "BRIC" countries of Brazil, Russia, India and China. To help biopharma IP practitioners in the NY/Philadelphia corridor prepare for this new era, the NJIPLA plans to sponsor an annual CLE series that will highlight hot IP issues in emerging markets of particular interest for the biopharma industry.
Rajita Sharma of Finers Stephens Innocent LLP provided updates on a variety of topics, including Sections 3(d) and 3(e) of the Indian Patent Act: Court and Patent Office interpretations and their implications for patenting biopharma invention. Attorneys João Luis Vianna and Gabriel Leonardos of Momsen, Leonardos & Cia presented information on several topics including views of the Brazilian Patent Office on patentability of selection inventions, polymorphs, and 2nd medical uses as well as ANVISA's role in examining biopharma patent applications.
This program was approved for 2.0 CLE credits in NJ and 1.5 CLE credits in PA.
